PRIVACY POLICY

Scope

The terms in this section apply to Scampoo and the Service as defined in the Scampoo End User Agreement Terms and Conditions. This Policy may be amended at any time by Logic, at Logic’s sole discretion. If the Policy is amended it will be posted in this section and shall apply to any then current Subscribers as well as new Subscribers.

Use of Subscriber Information

Subscriber information and any information contained in forwarded emails (“Subscriber Information”) will only be used to provide Subscriber with the Service including any purpose that is compatible with providing those services. Logic will not use Subscriber Information or derive information from it for any advertising by any third party which is not a Logic controlling entity or controlled subsidiary of Logic or any similar commercial purpose.

In addition to providing the Service, Logic may use the Subscriber Information for the following:

As between the parties, Subscriber retains all right, title, and interest in and to Subscriber Information. Logic acquires no rights in Subscriber Information, other than the rights Subscriber grants to Logic for the uses set forth above. This paragraph does not affect Logic’s rights in the Service which Logic provides to Subscriber.

Disclosure of Subscriber Information

Logic will not voluntarily disclose Subscriber Information outside of Logic, a Logic controlling entity or Logic’s controlled subsidiaries, contracted third parties and affiliates except (1) as Subscriber directs; (2) as described in this Privacy Policy; or (3) as required by law.

Logic does not voluntarily disclose Subscriber Information to law enforcement or non-contracted third parties. In the event Logic is required by law to disclose Subscriber Information to law enforcement or a third party, Logic will do so only to the extent necessary as provided by law.

Security

Logic is committed to helping protect the security of Subscriber Information. Logic has implemented, and will maintain and follow, appropriate and reasonable technical and organizational measures intended to protect Subscriber Information against accidental, unauthorized, or unlawful access, disclosure, alteration, loss, or destruction.

Security Incident Notification

If Logic becomes aware of any unlawful access to any Subscriber Information stored on Logic’s equipment or in Logic’s owned or contracted facilities that results in the loss, disclosure or alteration of Subscriber Information (each a “Security Incident”), Logic will: 1) notify Subscriber of the Security Incident; (2) investigate the Security Incident; and (3) take reasonable steps to mitigate the effects of, and minimize any damage resulting from, the Security Incident.

Security Incidents Notification(s) will be delivered to one or more Subscriber by a means selected by Logic, including via email. It is Subscriber’s responsibility to ensure that Subscriber maintains accurate and updated contact information to Logic. Logic’s obligation to report or respond to a Security Incident under this section is not an acknowledgement by Logic of any fault or liability with respect to a Security Incident.

Subscriber must notify Logic promptly of any possible security incident related to the Service of which Subscriber may be aware.

Location of Information Processing

Except as described elsewhere in the Privacy Policy or End User Agreement, Subscriber Information that Logic processes on Subscriber’s behalf may be transferred to, and stored and processed in, the United States or any other country in which Logic or its affiliates or subcontractors maintain facilities. Subscriber appoints Logic to perform any such transfer of Subscriber Information to any such facility and to store and process Subscriber Information in order to provide the Service

Use of Subcontractors

Logic may hire subcontractors to provide services on its behalf. Any such subcontractor will be permitted to obtain Subscriber Information only to deliver the services Logic has retained them to provide and will be prohibited from using Subscriber Information for any other purpose. Logic remains responsible for its subcontractors’ compliance with Logic’s obligations in this Privacy Policy and the End User Agreement. Subscriber consents to Logic’s transfer of Subscriber Information to subcontractors.
